1. Informational Purposes Only

All content on dynamicpsychology.com (the "Site"), including descriptions of psychotherapy modalities, treatment approaches, conditions addressed (e.g., anxiety, depression, trauma, attachment-related concerns, anger/irritability), blog posts, FAQs, video or audio materials, downloadable resources, links, and any other written or visual content, is provided for general informational and educational purposes only.


The Site is not intended to, and does not:

  • Diagnose, treat, cure, or prevent any mental, emotional, behavioral, or medical condition;
  • Provide individualized psychological assessment, clinical opinion, prognosis, or treatment recommendation;
  • Replace or supplement an evaluation conducted in the context of a professional psychologist–patient relationship; or
  • Constitute the practice of psychology as defined under New York Education Law § 7601-a.


Information on the Site is general in nature, does not account for any individual's specific history, symptoms, or circumstances, and may not reflect the most current clinical literature. Visitors should not rely on Site content as the basis for any decision affecting their mental health or medical care.  


2. Not a Substitute for Professional Clinical Advice

Nothing on the Site constitutes medical, psychological, psychiatric, psychotherapeutic, diagnostic, or other professional advice. Reading, viewing, or otherwise accessing Site content is not a substitute for consultation with a qualified, licensed mental health or medical professional who has personally evaluated you.


If you have, or believe you may have, a mental health condition, medical condition, or any concern about your psychological or physical well-being, you should consult a licensed clinician promptly. Never disregard, avoid, or delay seeking professional advice because of something you have read, viewed, or heard on this Site. Decisions about diagnosis, treatment, medication, or care must be made in consultation with appropriately licensed professionals who can evaluate your individual situation.


This Site does not recommend or endorse any specific test, clinician, product, procedure, opinion, treatment, medication, or other information that may be referenced.


3. No Therapist–Patient Relationship Established Online

Use of this Site does not create a psychologist–patient, therapist–client, doctor–patient, or any other professional treatment relationship between you and Jonathan Keigher, PhD, or any individual affiliated with this practice.

A professional treatment relationship is established only after all of the following occur:

  1. A formal intake process, including verification of identity and confirmation that you are physically located in New York State at the time of services;
  2. Completion and signing of written informed-consent documentation, including telehealth-specific informed consent where services are provided remotely, consistent with New York State Education Department Office of the Professions ("NYSED OP") telepractice guidelines;
  3. A clinical determination by Dr. Keigher that the modality and scope of services are appropriate to the prospective patient's needs; and
  4. Mutual written agreement to the practice's policies on fees, confidentiality, scheduling, and limitations of telehealth.


Communications submitted through the Site, including contact forms, email links, voicemail, social media direct messages, blog comments, or other electronic channels, do not establish a treatment relationship and are not confidential, secure, or HIPAA-protected channels. Do not transmit sensitive personal health information, clinical history, or crisis-related information through these channels. The practice does not guarantee that any such message will be received, reviewed within any particular time frame, or responded to.


Initial-consultation inquiries are screening conversations only and do not, by themselves, establish a treatment relationship. Dr. Keigher reserves the right to decline to enter a treatment relationship with any prospective patient for any lawful reason, including clinical appropriateness, scope of practice, jurisdictional limitations, or scheduling.


Jurisdictional Notice. Dr. Keigher is licensed to practice psychology in the State of New York. Telehealth and in-person services are provided only to individuals physically located in New York State at the time of the session. No content on this Site should be construed as an offer to practice psychology in any jurisdiction in which Dr. Keigher is not licensed.


4. Health-Related Statements and FTC Substantiation Notice

Statements on this Site about psychotherapy, treatment modalities (including psychodynamic psychotherapy), or the conditions for which Dr. Keigher provides treatment (including but not limited to anxiety, depression, trauma, anger/irritability, and attachment-related concerns) describe general clinical approaches and are not promises, guarantees, or representations of any specific therapeutic outcome.


No Outcome Guarantee. Individual results of psychotherapy vary substantially based on patient-specific factors, including but not limited to presenting concerns, history, engagement in treatment, therapeutic alliance, and external life circumstances. No statement on this Site should be interpreted as guaranteeing recovery, symptom resolution, cure, or any particular result.


Basis for Statements. Statements regarding the nature, methods, and general efficacy of psychotherapy on this Site are drawn from peer-reviewed clinical literature, professional training, and established practice standards, consistent with APA Ethics Code Standards 5.01 (Avoidance of False or Deceptive Statements) and 5.04 (Media Presentations). Where the Site references claims about the efficacy or benefits of any specific treatment modality, those statements are intended to summarize the general state of professional literature and are not specific representations about results any individual will achieve.


FTC Compliance. This Site is operated in a manner intended to comply with Section 5 of the Federal Trade Commission Act (15 U.S.C. § 45) and the FTC's Health Products Compliance Guidance (Dec. 2022), which requires that health-related claims be truthful, not misleading, and supported by competent and reliable scientific evidence. Where Site content discusses the efficacy of any treatment approach, the practice relies on the peer-reviewed clinical literature and accepted professional standards underlying that modality. The practice does not make, and disclaims any implied, "establishment" claims (e.g., "clinically proven," "studies show," "guaranteed") regarding outcomes for any individual.


Testimonials and Endorsements. The practice does not solicit, post, or display patient testimonials, reviews, or endorsements on this Site. This policy is intended to comply with: (a) APA Ethics Code Standard 5.05 (Testimonials), which prohibits psychologists from soliciting testimonials from current therapy clients/patients or other persons who, because of their particular circumstances, are vulnerable to undue influence; and (b) the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 C.F.R. Part 255. Any third-party reviews appearing on external platforms (e.g., Google, Yelp, ZocDoc, Psychology Today) are not solicited by, controlled by, or endorsed by the practice.


Affiliations and Compensation.  The practice does not receive compensation for referring to any third-party product, service, or website linked from this Site. If any such affiliate or compensated relationship arises in the future, it will be disclosed clearly and conspicuously at the point of reference, consistent with 16 C.F.R. Part 255.


Insurance and Network Status. References on the Site to insurance carriers (including but not limited to Aetna, UnitedHealthcare, and Oxford) describe in-network participation as of the date listed and may change. Coverage, copays, deductibles, and out-of-network reimbursement are determined solely by the patient's insurer; the practice makes no representation or warranty regarding any specific coverage outcome. 


5. Crisis and Emergency Protocol — Read Carefully

This Site, its email, contact forms, and all electronic communication channels are NOT monitored in real time and are NOT appropriate for emergencies of any kind. Messages may not be reviewed for hours, days, or longer.

Do not use email, the contact form, voicemail, or any messaging feature of this Site to communicate a crisis, suicidal ideation, intent to harm yourself or others, child or elder abuse, or any other emergency. If you are an existing patient and a crisis arises between sessions, follow the after-hours and emergency protocol provided in your signed informed-consent and practice-policies documents.


Mandated Reporting. As a licensed psychologist in New York State, Dr. Keigher is a mandated reporter under New York Social Services Law § 413 and is obligated to report suspected child abuse or maltreatment to the NYS Central Register, and to take appropriate action in duty-to-warn or duty-to-protect situations consistent with applicable law and APA Ethics Code Standard 4.05.


6. Privacy, Cookies, and Data Security

Your privacy is important. The practice's collection, use, storage, and disclosure of information through the Site and through professional services are governed by separate, more detailed notices:

  • Notice of Privacy Practices (HIPAA). Protected Health Information ("PHI") created or received in the course of professional services is governed by the practice's HIPAA Notice of Privacy Practices, provided to all patients at intake as required by 45 C.F.R. § 164.520. PHI is not collected through the public Site, and the public Site is not a HIPAA-covered communication channel.
  • Privacy Policy. Information collected automatically through the Site (e.g., IP address, browser type, referring URL, pages visited) and information submitted voluntarily through contact forms is governed by the Privacy Policy
  • Cookie Policy. Information about cookies, analytics tags (e.g., Google Analytics, if used), and similar tracking technologies used by the Site, and how to opt out, is set forth in the Cookie Policy. 


New York SHIELD Act. The practice maintains reasonable administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of private information of New York residents, consistent with the Stop Hacks and Improve Electronic Data Security ("SHIELD") Act, N.Y. Gen. Bus. Law § 899-bb.


Email and Electronic Communication. Standard email and the Site's contact form are not encrypted end-to-end and are not secure channels for transmitting PHI or other sensitive information. Patients who wish to communicate electronically with the practice will be offered HIPAA-compliant alternatives at intake.


Children's Privacy. The Site is not directed to children under 13, and the practice does not knowingly collect personal information from children under 13 through the Site.


7. Third-Party Links and Content

The Site may link to third-party websites, articles, or resources for informational convenience. The practice does not endorse, control, or assume responsibility for the content, accuracy, privacy practices, or availability of any third-party site. Use of any linked third-party site is at the user's own risk and subject to that site's terms and privacy policy.


8. Intellectual Property

All content on the Site, including text, graphics, logos, and original written materials, is the property of Jonathan Keigher, PhD, or used with permission, and is protected by U.S. and international copyright and trademark law. No content may be reproduced, redistributed, or used for commercial purposes without prior written permission, except as permitted by fair use.


9. Disclaimer of Warranties; Limitation of Liability

The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including without limitation warranties of accuracy, completeness, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted or error-free. To the fullest extent permitted by applicable law, Jonathan Keigher, PhD, and any affiliated entities, employees, contractors, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to a visitor's access to, use of, or inability to use the Site or any Site content, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages.

This Disclaimer and any dispute arising out of or relating to the Site is governed by the laws of the State of New York, without regard to conflict-of-laws principles. Venue for any dispute shall lie exclusively in the state or federal courts located in New York County, New York.
